If the alleged offence did not take place within the limits of his territorial jurisdiction or if the alleged offence is one which he is not competent to try, as for instance a complaint for the offence of bigamy punishable under Section 494 being filed before a second class Magistrate , the Magistrate should return the complaint to the complainant with the enclosures directing him to present it before a competent Court.
